Piracy ~ What to do, if your book is stolen. #Writetip #piracy

antipiracybadge3-1Sadly, book piracy is a topic we all need to deal with. Here is help from a number of sources.

1. Do thorough searches for all of your books and copy protected works, to work out the extent of the theft. Look for the title as well as your name, and be aware that pirates may shorten the title and misspell your name in order to fool the search engines. Carefully take screenshots, printed and pdf copies of all instances of the theft and note web addresses, ASINs, user names etc. You may also like to search for segments of the book’s text. I have found infringed articles of mine that way.

2. Set up a Google alert which will flag “Your Name” + “free ebook” or, even better, if you’ve published only one book, use “Your Name” +” title of your book,” + “free ebook.” This will help pick up further infringements.

3. If you are with a company, such as Amazon, they have departments to deal with infringements. Approach them first. They want to avoid litigation, so will take down pirated books and act in your favour. Under the Digital Millennium Copyright Act, a 1998 amendment of the Copyright Act of 1976, rights holders can request takedowns of infringing material. You can also hire a piracy protection company to help you. They will carry out complex searches which get to the bottom of the issue, however, you must be patient! Things take time.

4. Wikihow suggests that you then do this: send a note to the Copyright Officer of the site where your work was pirated (the links for doing this are at the base of book pages, which is shown in the screenshot below). Be polite, don’t threaten legal action. What these sites need is proof that you’re the author and copyright owner and that you did not authorize the file. If it was actually copyrighted through the government copyright office, say so and provide all reference numbers. Keep copies of all communications. Back them up!

Here’s a reporting format that generally works well:
For a hardcopy book:

“I am _____, the author and copyright owner of ____ published in hardcopy by ______ in (date). A pirated version has been uploaded to your site without my knowledge or permission by _____ (link to the member who uploaded the file). The book appears at this link on your site: _____ and I note that _____ unauthorized free copies have already been downloaded. The book is for sale on my website at _____ (or the publishers website or on Amazon.com). Let’s work together to get this file removed. You may write to me at ____.

For an ebook: “I am _____, the author and copyright owner of the ebook _____ published by _____. A pirated version has been uploaded to your site without my knowledge or permission by ____(link to the member who uploaded the file). The ebook appears at this link on your site: ____ and I note that ____ unauthorized free copies have already been downloaded. The book is for sale on my website at ____ (or other site where the book is sold on the web). Let’s work together to get this file removed. You may write to me at _____.

5. Tell your friends, tell your fan base, spread the word on social media, leave a bad review on any book pages claiming ownership and flagging that book as pirated, BUT… don’t threaten or antagonise pirates and don’t get mad and give them litigation relevant contact information such as your home address etc. You don’y want someone turning up on your doorstop, feeling scared of being sued and acting crazy. Protect yourself and play it firm, but cool.

6. Stay vigilant to ensure your book is removed and that it stays that way. Pirates may try again and again. Enlist the help of your social media buddies for this.

7. Even if your book is published on a free site and it’s under a Creative Commons licence, or is out of print, piracy is still illegal!

9. Don’t use torrent sites yourself! I know I shouldn’t have to say that, but… walk the walk, don’t just talk the talk!

Pirated books come from places such as peer-to-peer file sharing sites such as The Pirate Bay, KickAssTorrents, and Torrentz; cloud storage “cyberlockers,” such as Megashare and TUEBL (the Ultimate E-Book Library); and online reading sites, including Kiss-OfVampire.com and OnRead.com. Check them for your work.
